Last Monday, the Florida Supreme Court presented two rulings on abortion upholding a ban that protects the lives of the unborn, while leaving the decision up to Florida voters this fall as to whether to enshrine abortion protections in the state’s constitution. The court ruled 6-1 that a 15-week limit on abortions is constitutional while also upholding a law signed by the state legislature to protect the unborn at six weeks — which includes exceptions for rape, incest, fatal fetal anomalies and medical emergencies. Previously, Florida Republican Gov. Ron DeSantis signed a 15-week abortion ban, but pro-abortion organizations such as Planned Parenthood challenged the law arguing that Florida’s unique privacy clause should remain in effect. During the ruling on Monday, the court stated in a majority opinion that “Planned Parenthood cannot overcome the presumption of constitutionality and is unable to demonstrate beyond a reasonable doubt that the 15-week ban is unconstitutional.”
