TUPELO, Miss. — In 2022, Magistrate Judge Sarah Netburn moved a transgender rapist to a women’s prison. This decision did not stop President Biden from nominating her for a seat on the U.S. District Court for the Southern District of New York.
During a recent hearing, Judge Netburn was questioned by Republican Sen. Lindsey Graham if it is “possible to determine a person’s sex by only analyzing their chromosomes.” Judge Netburn answered Sen. Graham’s question by saying, “I have never studied biology and therefore I am unqualified to answer this question.”
Judge Netburn’s answer is not only a concern for the female inmates that have to live with a male, but a concern for the future of America’s prison system.
“President Biden’s judicial nominee, Magistrate Judge Sarah Netburn, displayed a shocking disregard for basic scientific facts by refusing to affirm that chromosomes determine biological sex, claiming she never studied biology,” says Walker Wildmon, CEO of AFA Action, the government affairs affiliate of the American Family Association. “This evasive response undermines the credibility and competence required for a federal judge. It is alarming that someone who may not recognize fundamental biological truths could be entrusted with decisions that impact our legal system and societal norms. Judge Netburn’s prior decision to transfer a male child sex abuser to a female prison, against the Bureau of Prisons’ recommendation, further exemplifies her dangerous disregard for reality and safety.
“This situation underscores the essential work of the Center for Judicial Renewal (CJR) at AFA Action. The CJR is dedicated to restoring the judiciary to its rightful role of interpreting the law based on the original meaning of the Constitution. Our judiciary must be grounded in objective truth, which aligns with both scientific facts and biblical principles. The Senate must reject this nominee to ensure our legal system remains anchored in factual and moral clarity, safeguarding our nation’s principles and the well-being of its citizens. We urge all concerned citizens to support the CJR’s efforts in promoting judicial candidates who uphold these fundamental truths and principles.”
