Religious freedom on trial after Supreme Court rejects appeal from Christian baker

TUPELO, Miss. — After years of ongoing battle between the state of California and Christian baker, Cathy Miller, the Supreme Court has denied hearing an appeal in the case of California Department of Civil Rights v. Tastries, allowing a lower court ruling against Miller to stand.

 

In 2017, the California Civil Rights Department filed a complaint against Miller, stating that her bakery violated the Unruh Civil Rights Act after declining to bake a wedding cake for a same-sex couple; Miller declined to bake the cake due to her religious beliefs on same-sex marriage. In 2018, a California Superior Court Judge ruled in favor of Miller, and in 2022, a judge ruled that California’s Department of Fair Housing and Employment failed to prove that Miller had engaged in discrimination. But, according to The Christian Post, “in February, the Court of Appeal of the State of California, Fifth Appellate District ruled against Miller, concluding that the baker engaged in ‘intentional discrimination’ to refuse to sell a pre-designed white cake to the couple for their wedding.”

 

“Freedom itself is on trial when a Christian business owner is punished for living out her faith,” said Walker Wildmon, CEO of AFA Action, the governmental affairs affiliate of the American Family Association. “Cathy Miller wasn’t discriminating; she was exercising her First Amendment rights. But in California, religious liberty now comes with an asterisk. California’s refusal to hear her case shows how far the state is willing to go to silence dissent from its agenda. But this fight is far from over. AFA Action is committed to defending religious liberty at every level — because no American should be forced to celebrate what violates their faith.”
