TUPELO, Miss.  Today, the Nebraska legislature passed Legislative Bill 935. Under the bill, victims of online obscenity and child sexual abuse material can sue websites profiting from extreme and illegal pornographic content, such as rape videos. LB935 is an omnibus bill that incorporates language from the original bill, LB978.

Online child pornography has risen to levels never seen before. A recent report from the MIT Technology Review states that “the US now hosts more child sexual abuse material online than any other country.” In addition, the average age of exposure to harmful pornography continues to creep lower and is now age 12, with some reporting exposure as early as age 5.

“The online pornography industry will never police itself. They are more than willing to turn a profit by hurting children,” said Dr. Jameson Taylor, director of the Center for Government Renewal with AFA Action, the governmental affairs affiliate of the American Family Association. “Nebraska is putting these child traffickers on notice. Once Governor Pillen signs this bill, porn companies will be forced to remove illegal, harmful content from their websites.”

“It is already a crime for a website to make child pornography or obscenity available online,” noted AFA Action Senior Legal Fellow Trey Dellinger. “The U.S. Supreme Court has unequivocally held that child pornography and obscenity are not First Amendment-protected speech. The problem is enforcement. Law enforcement and prosecutors don’t have the resources to go after these criminals. This new Nebraska law is a force multiplier that will help rein in the online exploitation of children and vulnerable women.”

“Child porn is a billion-dollar industry. Big Porn is a $100 billion industry, and much of that money is being made from harmful, degrading and legally questionable content,” said Taylor. “Nebraska is standing up to Big Porn to keep kids safe online.

“This bill would not have become law without the tireless dedication of its author, Sen. Tanya Storer. We likewise want to thank Judiciary Committee Chair Sen. Carolyn Bosn and Sen. Dave Murman for getting this bill to the governor’s desk. The Nebraska Family Alliance also did an incredible job guiding this bill to passage.”
