TUPELO, Miss. — In a federal lawsuit, Louisiana recently filed a motion to temporarily reestablish an in-person mandate for dispensing abortion pills, which could save thousands of unborn lives. The state’s motion questions the 2023 Risk Evaluation and Mitigation Strategy rule from the FDA; this permits remote prescription and mailing of mifepristone, the abortion drug. Louisiana Attorney General Elizabeth Murrill, who filed the original complaint on Oct. 6, 2025, underscored the dangers this rule poses: “We support the Trump administration which has acknowledged the flaws in the original rule. But unfettered and unsupervised access to these pills is dangerous. So the Biden-era rule should be enjoined.”
“Louisiana is pushing back against a federal policy designed to override state law and funnel abortion pills into pro-life states through the mail,” said Walker Wildmon, CEO of AFA Action, the governmental affairs affiliate of the American Family Association. “The Biden administration’s FDA rule didn’t protect women — it was a deliberate effort to expand abortion by eliminating oversight, safeguards, and accountability. Shipping chemical abortion drugs across state lines is not health care; it is a way to bypass state laws meant to protect unborn children and their mothers. Louisiana is drawing a firm line and saying federal agencies do not have the authority to impose abortion on states through bureaucratic maneuvering. If this rule is overturned, it will shut down a dangerous pipeline of abortion drugs and protect lives that were created in the image of God and never meant to be discarded.”
