TUPELO, Miss. — U.S. District Court Judge Karin Immergut recently twice enjoined President Trump from sending National Guard troops into Oregon to combat violence against federal officials and facilities. Judge Immergut’s ruling continues a concerning pattern of federal judges interfering with President Trump’s appropriate exercise of executive power, in other words, acting as “fake little presidents in black robes.” What does Judge Immergut’s ruling tell us about the nomination of Rebecca Taibleson to the U.S. Court of Appeals for the Seventh Circuit?
Both of their nominations are the products of Democrat involvement in the nominations and confirmation process via so-called “bipartisan” judicial selection committees.
Judge Immergut applied for the Oregon district court vacancy in 2017. Her application was sent to the judicial selection committee created by the two U.S. Senators for Oregon, Democrats Ron Wyden and Jeff Merkley, along with then Republican Congressman Greg Walden. This judicial selection committee interviewed Immergut and submitted her name, among others, to the White House Counsel’s Office for further consideration, ultimately resulting in Judge Immergut’s confirmation to the U.S. District Court for the District of Oregon. So what does this have to do with Rebecca Taibleson?
Taibleson was also recommended by a “bipartisan” judicial committee formed in part by the ultra-liberal democrat Senator Tammy Baldwin. AFA Action’s Center for Judicial Renewal has already identified a number of serious concerns about Seventh Circuit nominee Rebecca Taibleson, and this activist ruling by Judge Immergut emphasizes a major concern about Taibleson that many seem quick to dismiss — Taibleson’s nomination, like Judge Immergut’s, was recommended to the White House by a Democrat influenced “bipartisan” judicial selection committee.
Walker Wildmon, CEO of AFA Action, the governmental affairs affiliate of the American Family Association, commented on this overlooked concern about Ms. Taibleson, highlighting the risk presented by nominees recommended by bipartisan judicial selection committees.
“Judge Immergut’s ruling exemplifies the importance of nominating only the best nominees to the federal bench and showcases the danger of even Trump-appointed judicial nominees who derive from bipartisan judicial selection committees,” said Wildmon. “Taibleson’s nomination, having been recommended by the bipartisan judicial selection committee of U.S. Senators Ron Johnson (R-WI) and radical leftist Senator Tammy Baldwin (D-WI), and accompanied by a number of other very serious concerns in her record, presents an unacceptable risk to constitutionalism. The nomination of Rebecca Taibleson to the Seventh Circuit presents even higher stakes than the nomination of Judge Immergut, given that Taibleson is a Circuit Court nominee and there is potential for a Supreme Court vacancy in the near future. Taibleson’s nomination ought to be strongly opposed.”
