America cannot afford another activist Supreme Court Justice

TUPELO, Miss. — America is in a tumultuous political position, with both Democrats and Republicans jockeying for power within all three branches of government. As the highest court in the nation, the Supreme Court oversees the third branch of the nation’s government. Amid growing division and challenges to institutional trust, it is essential that all justices remain committed to their oath to support and defend the Constitution. That is why AFA Action’s Center for Judicial Renewal (CJR) has compiled a “green list” of Supreme Court prospects who possess the best long-term, demonstrable record of commitment to the constitutional role of judges: deciding cases according to the original meaning of the Constitution and legislative texts, and never legislating from the bench.

“The late Justice Antonin Scalia warned that nominating federal judges had become an ‘eminently political, results-oriented process.’ In recent years, that concern has only intensified,” said AFA Action CEO Walker Wildmon. “When there is a vacancy on the Supreme Court, President Trump must nominate an individual who is able, impartial, and possesses the necessary character. The next Supreme Court justice must have the proper judicial philosophy, courage and conviction to make rigorously constitutionalist rulings rooted in the text. We need another judge who, like Justices Clarence Thomas and Samuel Alito, consistently demonstrates a constitutionalist and originalist approach. The next Justice must possess a principled judicial philosophy rooted in the constitutional text, with a demonstrable record of the courage to apply that philosophy consistently.”

A Supreme Court nominee must be grounded in the strongest constitutionalist principles — one who consciously and carefully rules in accordance with the text, resists the allure of judicial activism, and respects the limits of his or her judicial role. In order to identify prospective nominees that meet this standard, CJR’s dedicated team of researchers has thoroughly completed 15,000 hours of research on federal judicial prospects in 11 vital areas, including judicial philosophy and faith and worldview.

“If Justice Thomas or Alito were to retire, we would lose one of the Court’s most faithful constitutional judges. Their possible absence underscores the importance of selecting the right nominee to replace them. President Trump must nominate someone with a proven record of commitment to the constitutional role of the Supreme Court,” concluded Wildmon.
