TUPELO, Miss. — During President Trump’s recent “Trump accounts” speech, he suggested Senator Ted Cruz as a future Supreme Court justice nominee. The president called out Cruz as a “brilliant legal name … a brilliant man,” and mentioned that he will get 100 percent of the vote if he nominates the senator.
“President Trump floated the idea of putting Senator Cruz on the Supreme Court, but Cruz quickly shot down the speculation, citing his plans to run for president,” said Phillip Jauregui, senior counsel at AFA Action’s Center for Judicial Renewal (CJR).
Reacting to Trump’s prospective nomination, Cruz noted that he has repeatedly told Trump that he would not accept a SCOTUS nomination; he believes that a federal judge needs to avoid political and policy conflicts.
“So, the big question is: Why put the idea out there at all? One possibility is that Trump is looking to clear the presidential field for contenders such as J.D. Vance or Marco Rubio by offering Cruz another path. If that’s the case, conservatives might ask if a similar offer could be extended to someone like Governor DeSantis — who CJR has not yet researched — but could be a strong justice,” said Jauregui.
“The bigger question: Why are we even talking about a vacant ‘seat’ when a vacancy doesn’t currently exist? Eight years ago, at the same point in Trump’s first term, discussions were quietly underway behind the scenes with Justice Kennedy months before his retirement. While we aren’t sure of what could be coming, history suggests we’d better be ready!”
